The second question of Fatwa No. ( 7137 ):
Q2: Whatis the ruling on one who builds or constructs, or participates in building, a mosque that is established on the grave of a manand next to it are a number of graves, and does he see manifestations of shirk (associating partners with Allah) in this place, especially those engaged in current trades such as decoration and coloring, and what should he do with the money he earned from this work, especially since he is in dire need of it?
A2: It is authentic from the Messenger of Allah (peace and blessings be upon him) that he said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد

, and it is authentic from him (peace and blessings be upon him) that he said:
Beware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.ألا وإن من كان قبلكم كانوا يتخذون قبور أنبيائهم وصالحيهم مساجد، ألا فلا تتخذوا القبور مساجد، فإني أنهاكم عن ذلك
Sahih Muslim 532
, and it is authentic from him (peace and blessings be upon him) that he prohibited plastering graves, building on them, and sitting
on them. Therefore, it is not permissible for a Muslim to do what Allah has prohibited or to assist in it. And whoever does any of that or participates in it must repent to Allah (Glorified and Exalted is He) and remove the munkar (what is wrong) he has done if he is able to do so. And if his repentance is sincere and his deeds are good in his life after repentance, we hope that Allah will pardon him and forgive him for what he did before repentance. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
