Q: Some people say: The ruling on prayer differs in a mosque that contains one grave from a mosque that contains two graves from a mosque that contains three or more. We ask for clarification on this, and what is the ruling? The Prophet (peace and blessings be upon him) said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد

Knowing that some people who come from the Holy City of Madinah argue that the Prophet’s (peace and blessings be upon him) mosque contains his grave (peace and blessings be upon him) and the graves of his two companions (may Allah be pleased with them), so it is like the general mosques where prayer is permissible. We ask for clarification.

A: The Messenger (peace and blessings be upon him) cursed those who build mosques over graves and warned against that, as in the previous hadith. He said:
Beware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.ألا وإن من كان قبلكم كانوا يتخذون قبور أنبيائهم وصالحيهم مساجد ألا فلا تتخذوا القبور مساجد فإني أنهاكم عن ذلك

narrated by Muslim in the Sahih. The two Shaykhs (al-Bukhari and Muslim) narrated from Aisha (may Allah be pleased with her) that Umm Habibah and Umm Salimah (may Allah be pleased with them both) mentioned to the Prophet (peace and blessings be upon him) a church they had seen in the land of Abyssinia and the images in it, so he said:
If any righteous pious man dies amongst them, they would build a place of worship at his grave and make these pictures in it; they are the worst creatures in the sight of Allah.أولئك إذا مات فيهم الرجل الصالح بنوا على قبره مسجدًا وصوروا فيه تلك الصور أولئك شرار الخلق عند الله

So he (peace and blessings be upon him) made it clear that those who build mosques over graves are the worst of creation in the sight of Allah, and he warned against their action. This indicates that a mosque built over a grave or more is not to be prayed in, and there is no difference between one grave or more. If the mosque was built later over the graves, it is obligatory to demolish it, and the graves should be left exposed without any building over them, as the graves were in his time (peace and blessings be upon him), in al-Baqi' and elsewhere, and so it is to this day in the Kingdom of Saudi Arabia, so the graves there are exposed without any building, domes, or mosques, and praise and grace belong to Allah.
As for if the mosque is old but a grave or more was added to it, then the grave is to be dug up and its occupant moved to the public cemeteries that have no domes, mosques, or buildings over them, and the mosque remains empty of them so that prayer can be performed in it.
As for the argument of some ignorant people regarding the presence of the Prophet’s (peace and blessings be upon him) grave and the graves of his two companions in his mosque, there is no proof in that; because the Messenger (peace and blessings be upon him) was buried in his house and not in the mosque, and his two companions Abu Bakr and 'Umar (may Allah be pleased with them both) were buried with him. But when al-Walid ibn 'Abd al-Malik ibn Marwan expanded the mosque, he included the house in the mosque due to the expansion, and he erred in this. It was obligatory that he not include it in the mosque so that the ignorant and their like would not argue with it. The people of knowledge refuted him regarding this, so it is not permissible to follow him in this, and no one should think that this is of the same kind as building over graves or making them into mosques; because this is an independent house that was included in the mosque out of the need for expansion, and this is of the kind of the cemetery in front of the mosque, which is separated from the mosque and does not harm it. And so the Prophet’s (peace and blessings be upon him) grave is separated by a wall and bars.
It is recommended for the Muslim to clarify this to his brothers so that they do not err in this issue.
