Q: A man built a mosque in Yemen and instructed his family to place his grave in the mosque . He actually passed away and was buried in the mosque in front of the qiblah, with a distance of one meter between the grave and the mosque. I ask for guidance on this matter?
A: It is obligatory to exhume this grave and place it in a location far from the mosque, in the town's cemetery. This is because placing a grave in the mosque is a means to shirk (associating partners with Allah). If it is in the direction of the qiblah, the prohibition is more severe and it is closer to shirk with Allah, through the worship of the person in the grave. The basis for this is what al-Bukhari and Muslim narrated in the two Sahihs, from Abu Hurayrah (may Allah be pleased with him), who said: The Messenger of Allah (peace and blessings be upon him) said:Muwatta Malik 45:17. And Muslim reported that the Prophet (peace and blessings be upon him) said: Jami` at-Tirmidhi 1050Sahih (Darussalam). And Muslim also reported that the Prophet (peace and blessings be upon him) said: Sahih Muslim 532. And success is from Allah.
