Fatwa number ( 10422 ):
Q: In the middle of our city, there is an old cemetery. The municipality removed its remains and built a residential neighborhood and buildings for low-income earners in its place. A large area remained, and the people of righteousness and benevolence built a mosque on it for the residents of the neighborhood to pray in. After the mosque was built, a dispute arose among the people of the town regarding the permissibility of praying in this mosque or its impermissibility, and they divided into supporters and opponents. What is the ruling on this mosque? Must it be demolished, or should it be kept? Is the prayer in this mosque valid or not?
A: If the land on which a mosque is built is free of
graves, the prayer in it is valid; otherwise, the mosque built on it must be demolished. And success is from Allah. May Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
