Islam, and its opposite is disbelief. It is not obligatory for a disbeliever to perform Hajj. It is not obligatory for a disbeliever to perform Hajj. For this reason, if we find a disbeliever, we do not say to him: "Perform Hajj." We say to him: "First become a Muslim, then perform Hajj." Intellect, and its opposite is insanity. So if it is assumed that a person has been insane since his childhood and he has a lot of wealth, but he is insane, then Hajj is not obligatory upon him, nor is Hajj performed on his behalf, because he is not of sound mind, because he is not of sound mind. So if we find someone who is mentally deficient since his childhood, who has wealth and has a father who can perform Hajj on his behalf, then Hajj is not obligatory upon him due to the lack of intellect.
Maturity, and its opposite is childhood. So if he dies before reaching maturity, then Hajj is not performed on his behalf. That is, Hajj is not obligatory on his behalf, because he is a child. Even if it is assumed that this child has a lot of wealth and dies, then Hajj is not performed on his behalf from it, because Hajj was not obligatory upon him. But by what is maturity attained? For men, it is attained by one of three things: First: that he completes fifteen years of age. Second: that his pubic hair grows. Third: that semen is discharged through desire or wet dreams. How many are these? Three signs of maturity in men. As for women, a fourth sign is added for the woman, which is: menstruation. So if she menstruates, even if she is only ten years old, she is mature.
The fourth: - the fourth of the conditions for the obligation of Hajj - : Yes. Freedom, and its opposite is slavery. So the enslaved slave does not have Hajj obligatory upon him, because he does not have wealth, for his wealth belongs to his master.
As for the fifth, it is the ability to perform it. And it is the condition that Allah mentioned in the Qur'an and which the Sunnah also brought
for whoever is able to find thereto a way مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلاً

meaning whoever is able to perform Hajj. As for whoever is not able, then Hajj is not obligatory upon him. But if he has wealth, then he appoints someone to perform Hajj on his behalf. That is: he delegates someone to perform Hajj on his behalf, as long as he does not hope to be able to do so in the future, then he does not delegate someone to perform Hajj on his behalf. And when the inability is removed, it becomes obligatory upon him to perform Hajj himself. An example of that: a man who has a lot of wealth but has an illness that is not expected to be cured, or old age, and old age is not expected to be removed. Is it obligatory for him to delegate someone to perform Hajj on his behalf? Answer, everyone. Yes, it is obligatory for him, because he is able with his wealth, so it is obligatory for him to appoint someone to perform Hajj on his behalf.
A second example: a man who has wealth and is unable to perform Hajj this year. But his illness is expected to be cured. So is it obligatory for him to appoint someone to perform Hajj on his behalf, or does he wait until next year? He waits until next year. And it is not valid for him to appoint someone to perform Hajj on his behalf, because he is able to do it himself.
A third example: a person who has wealth and is physically able. Is it obligatory for him to perform Hajj this year, or do we tell you to postpone it to the second year? It is obligatory for him to perform Hajj this year. And it is not permissible for him to postpone it to the second year, because Hajj is immediate.
A fourth example: a person who is physically able but does not have wealth. Is it obligatory for him to perform Hajj? No. There is a detail: if he is able to walk and the expense does not exceed the expense of staying, then it is obligatory for him to perform Hajj, like a man from the people of Makkah who does not have wealth. But he is able, he can go out with the people to 'Arafah and return. We say: it is obligatory for him to perform Hajj - pay attention - because Allah said:
for whoever is able to find thereto a way مَنْ اسْتَطَاعَ إِلَيْهِ سَبِيلاً
[Ali 'Imran 3:97]
