The Shaykh :
she is not lawful to him afterward until [after] she marries a husband other than him فلا تحل له من بعد حتى تنكح زوجاً غيره
[Al-Baqarah 2:230]
And by Allah, I think I reviewed the case. I think it is not a condition, as long as he did not consummate the marriage with her, as long as he did not consummate the marriage with her.
