The Tenth Deviation from the Sunnah: The Hadith of Judging by One Witness and an Oath.

Machine translationRead the Arabic original
The Shaykh : Tenth, or the tenth: The hadith of judging by one witness and an oath. What does "one witness and an oath" mean? Do you know that most cases require two just witnesses? But sometimes it is not possible for a person to find more than one witness. So, in many hadiths, it is sufficient for the plaintiff to swear an oath along with his one witness, and his oath takes the place of the second witness. The Hanafis do not accept this hadith. Why? Because this fits the rule mentioned earlier, which is that it contradicts the principles. What did he say here? Second: Rejecting a solitary report if it contradicts the principles. One of the principles is that two just witnesses are necessary. Well, this hadith says that one witness with an oath is sufficient. They rejected it. This rejection, naturally, is refuted by many examples, because as long as this hadith is authentic, the one who established the principle that two just witnesses are necessary also established another principle: if one of the witnesses is not available, one witness with the plaintiff's oath is sufficient. Who has discussed this topic with the most precise scientific research? The Shaykh "Abd al-Rahman al-Mu'allimi al-Yamani" in his truly great book, "Tanqil bi ma fi Ta'nib al-Kawthari min al-Abatil." This book is in two volumes, written by the Shaykh "Abd al-Rahman al-Mu'allimi al-Yamani." For the first time, it was printed with the verification of Al-Albani. Then, recently, several editions were printed. The approved legal edition after the first edition is the second edition, also with the verification of Al-Albani and a new introduction, published by Maktabat al-Ma'arif in Riyadh. This is a new edition with my introduction.
On this occasion, I draw your attention to the fact that there are several editions: an Indian edition and a Saudi edition published by the Council of Senior Scholars. These two editions are exact copies of the first original edition that I had printed, annotated, and also published at my own expense. The Shaykh : Muhammad Nasif, a noble and virtuous scholar, and his partners. These two editions, the Indian one and the Council of Senior Scholars one, are naturally distributed for free. They are exact copies of the original, with no changes or alterations. Then there is the edition of mine, which is the same one published by a publisher in Cairo whose office is called al-Maktab al-Salafi. He stole this book and changed the cover. It was written "Verification by Muhammad Nasir al-Din al-Albani," so he added a name of his own to mislead his customers into thinking that this book or this edition is different from the previous one. The previous one was only with the verification of Al-Albani, whereas this one is with the verification of Al-Albani and an addition from him, Muhammad Abd al-Razzaq Hamza. This is forgery and a lie. And it is even more astonishing than what was mentioned that Muhammad Abd al-Razzaq Hamza is dead and has no relation whatsoever to this book in terms of its printing, publishing, or annotation. But may Allah guide him; he added this name for commercial purposes, claiming that the edition has two verifiers. The previous old edition is only with the verification of Al-Albani, and it is the same as Al-Albani's edition, but he added this second name.
The student : What is the name of the book, my Shaykh?

The Shaykh: Yes.
The student : The name of the book.

The Shaykh : I said: "Tanqil bi ma fi Ta'nib al-Kawthari min al-Abatil." Then another thief came and "added a bundle of straw to a camel's load." It is the same book of mine, and he said "Verification by Muhammad Nasir al-Din al-Albani, Zuhayr al-Shawi, and Abd al-Razzaq Hamza." It became three, but it is the same as the first. However, this second thief is worse than the first, because he added some comments that have no value, and without my permission as well, as I mentioned in the introduction to the second legal edition, which was published by Dar al-Ma'rifah.
The student : Dar al-Ma'arif.

The Shaykh : Dar al-Ma'arif in Riyadh. This is the one you should look for: Dar al-Ma'arif in Riyadh.
The student : So, nothing was added, our Shaykh, to the names of these thieves.

The Shaykh : No, never.
The student : Except the original edition.

The Shaykh : Yes, indeed. So, the best research on the hadith of judging by one witness and an oath is by the author of this book, whose name is "Abd al-Rahman al-Mu'allimi al-Yamani." He refuted the Hanafis with a very strong scientific refutation.
