The Shaykh : Here we have a topic that interests our guest today, who is recording it. It is a study by one of our senior brothers, Dr. Marwan al-Qaysi, in his book *Ma'alim al-Huda ila Fahm al-Islam al-Haqiqi* (Landmarks of Guidance to Understanding the True Islam). This book represents the Salafi call in many of its aspects. Among these is that he dedicated a chapter to refuting late jurisprudence that gives no weight to the established Sunnah of the Prophet (peace and blessings be upon him). By late jurisprudence, I mean traditional jurisprudence, even if its history dates back to the fourth or fifth century, because this traditional jurisprudence truly gives no weight to the Sunnah. This is because, as stated in some of the principles of traditional jurisprudence, if an authentic hadith from the Messenger (peace be upon him) that contradicts the madhhab is presented to them, they reject it and prefer the madhhab over it. And if a verse contradicts the madhhab, they interpret it figuratively. This is explicitly stated in some of the late jurisprudential madhhabs. Our brother, Dr. Marwan al-Qaysi, addresses such a statement and says, "There are other manifestations of turning away from the Sunnah and denying it, especially among some of the jurisprudential madhhabs. He mentioned among them:The Shaykh : Muhammad Nasir al-Din al-Albani lists the following: First, preferring analogical reasoning (qiyas) over a report from a single narrator (khabr al-ahad). Preferring qiyas over khabr al-ahad means that this statement or this rule was a cause for turning away from the Sunnah under the pretext that such a Sunnah contradicts qiyas. The source states, "The media, in summary, page so-and-so, Sharh al-Minar, and so on." Then he mentions second, rejecting a report from a single narrator if it contradicts the principles. He also mentions some sources, the two previously mentioned. Third, rejecting a hadith that contains a ruling in addition to the text of the Qur'an, on the claim that this abrogates it, whereas the Sunnah does not abrogate the Qur'an. This paragraph is contrary to what we answered in the recent lesson. The Sunnah does not abrogate the Qur'an. I do not know if the author, may Allah bless him, will mention the many examples he quoted from the author previously mentioned, who is al-Albani. I do not remember if there is an example in them of how they rejected the hadith and did not act upon it, claiming that it contradicts the Qur'an. So let us keep this in mind, and if it comes in the list of examples he will present, let it draw your attention to this rule at that time. Then he says, Fourth, the impermissibility of specifying the generality of the Qur'an with a report from a single narrator. He also mentions some sources here from the Hanafi sources and adds *Irsad al-Fuhul* by al-Shawkani. Here I say that one should not assume that when he mentioned sources for the rule of the impermissibility of specifying the generality of the Qur'an with a report from a single narrator, that al-Shawkani holds this view. He only mentioned the book *Irsad al-Fuhul* by al-Shawkani as one of his sources. Rather, al-Shawkani mentioned this rule by quoting it from the Hanafis, quoting it from the Hanafis. This also has examples, which may come up later. Finally, or fifth, preferring the practice of the people of Madinah over the authentic hadith. He says that this previous source was the source of the previous one, Muhammad Nasir al-Albani, in his book *Al-Hadith Hujjah bi-Nafsihi fi al-'Aqaid wa al-Ahkam* (The Hadith is a Proof in Itself in Beliefs and Rulings). Then he says, and this is the important part of the topic, "And he givesThe Shaykh : al-Albani practical examples of contradicting authentic hadiths. I have found it useful, indeed necessary, to bring these examples so that the dear reader realizes that the matter is very serious and that turning away from the Sunnah of the Messenger of Allah (peace and blessings be upon him) has become widespread."
