The Shaykh : Number twelve: Whoever marries his father’s wife has his neck struck and his wealth taken. This refers to a hadith in the two Sahihs:
A man married his father’s wife, so when the Messenger (peace be upon him) was informed, he ordered one of the Companions, and it was probably al-Bara’ ibn ‘Azib, to kill him and cut off his head. أن رجلًا نكح امرأة أبيه ، فلما أخبر الرسول - عليه السلام - أمر أحد الصحابة ولعله البراء بن عازب بأن يقتله وأن يقطع رأسه
; because he married his father’s wife, do they not act upon this hadith? The principle is that one must look to see if he is a muhsan (one who has previously married) or not. If he is a muhsan, he is killed; if he is not a muhsan, he is not killed. Here, he is killed without distinction. This hadith specifies the general rule, yet they held onto the general rule and left the specific exception.
