The Shaykh : What concerns us now, on the occasion of this question about the Prophet (peace and blessings be upon him) drinking while standing, is this: If a prohibitive ruling and a permissive ruling conflict, and it is not possible to reconcile them by any of the many methods of reconciliation—of which al-Hafiz al-Iraqi mentioned more than a hundred in his commentary on Ibn al-Salah’s Introduction to the Sciences of Hadith—then if the researching scholar is unable to reconcile two hadiths, he resorts to this rule: “When a permissive ruling and a prohibitive ruling conflict, the prohibitive is given precedence over the permissive. Likewise, when his (peace be upon him) action conflicts with his statement, his statement is given precedence over his action.” This is because his (peace and blessings be upon him) statement is a general legislation, whereas his action may carry several possible interpretations.
