The Shaykh : Indeed, all praise is due to Allah; we praise Him, seek His help, and seek His forgiveness. We seek refuge in Allah from the evils of our own selves and from the evil of our deeds. Whomsoever Allah guides, none can misguide, and whomsoever He leaves to misguide, none can guide. And I bear witness that there is no deity worthy of worship except Allah alone, with no partner, and I bear witness that Muhammad is His slave and His Messenger:
O you who have believed, fear Allah as He should be feared and do not die except as Muslims [in submission to Him]. يا أيها الذين آمنوا اتقوا الله حق تقاته ولا تموتن إلا وأنتم مسلمون
[Ali 'Imran 3:102]
O mankind, fear your Lord, who created you from one soul and created from it its mate and dispersed from both of them many men and women. And fear Allah, through whom you ask one another, and the wombs. Indeed Allah is ever, over you, an Observer. يا أيها الناس اتقوا ربكم الذي خلقكم من نفس واحدة وخلق منها زوجها وبث منهما رجالا كثيرا ونساء واتقوا الله الذي تساءلون به والأرحام إن الله كان عليكم رقيبا
[An-Nisa 4:1]
(70) O you who have believed, fear Allah and speak words of appropriate justice. (71) He will [then] amend for you your deeds and forgive you your sins. And whoever obeys Allah and His Messenger has certainly attained a great attainment. يا أيها الذين آمنوا اتقوا الله وقولوا قولا سديدا * يصلح لكم أعمالكم ويغفر لكم ذنوبكم ومن يطع الله ورسوله فقد فاز فوزا عظيما
[Al-Ahzab 33:70-71]
.
As for what follows: The best of speech is the speech of Allah, the best of guidance is the guidance of Muhammad, and the worst of matters are those that are newly invented. Every newly invented matter is a religious innovation, every religious innovation is misguidance, and every misguidance is in the Fire.
And after that: A question was just raised about a man who wore two socks and prayed the prayers he prayed after wiping over them, then removed them, and his ablution was not broken by any of the known invalidators of ablution. So, does removing his socks break his ablution and prevent him from performing prayer, even though his ablution was not broken by any of those invalidators?
The answer is: There is no evidence in the Book or in the Sunnah that removing what is wiped over, such as socks, breaks the ablution, whether absolutely or temporarily. I say absolutely or temporarily, because some scholars hold that it breaks the ablution absolutely, just as if an invalidator of ablution came out of him; they considered removing the leather socks or socks to be an invalidator of the ablution. Some of them said: It breaks the ablution temporarily, such that if he washes his feet after removing his leather socks or socks, his ablution becomes valid, and consequently his prayer. The correct view is that removing what is wiped over does not break the ablution absolutely. The only thing is that by doing so, he is no longer able to return to wiping over them if he returns to wearing them. One of the conditions for wiping over socks is that one must have put them on while in a state of complete purity, as came in the hadith of al-Mughirah ibn Shu'bah (may Allah be pleased with him) regarding the incident of his journey with the Prophet (peace and blessings be upon him). When he went out in the morning to relieve himself, then came to perform ablution, al-Mughirah ibn Shu'bah poured the water for his ablution over him. When it came to the washing of the feet, al-Mughirah ibn Shu'bah was about to remove the leather socks from the feet of the Prophet (peace and blessings be upon him and his family), so he said:
He ordered me to leave them as he had put them after performing ablution دعهما فإني أدخلتهما طاهرتين
Sahih al-Bukhari 206
Meaning complete purity, meaning that he (peace be upon him) performed ablution in which he washed his feet, then put on his leather socks over them. Therefore, it was permissible for him to wipe over them at that time. The scholars of hadith took from this authentic hadith, which is in al-Bukhari, that it is a condition for wiping over leather socks that one must put them on while in a state of complete ablution. In the case of the previous question, he removed them, and we mentioned that removing them does not break his ablution. However, since he had already wiped over them, it is not permissible for him to return to wearing them and then wiping over them, because in this case he would not have put them on while in a state of complete purity. Rather, he put them on after having wiped over his feet by means of wiping over the socks. This is what can be mentioned on this occasion regarding the fact that removing what is wiped over does not break the ablution.
