The Shaykh : But do you think the reverse is the same? That is, if a Muslim kills a dhimmi without right, rather by aggression, injustice, and transgression, is the Muslim killed for that dhimmi? In this issue, there are two schools of thought among the four schools of jurisprudence. The Hanafi school holds that this Muslim who intentionally and deliberately kills a dhimmi is killed. As for the school of the majority, he is not killed, and this is the correct view. The correct view is that if a dhimmi is killed by a Muslim, it is not permissible to kill that Muslim for that dhimmi, due to the saying of the Prophet (peace and blessings be upon him):
The Muslim is not killed for disbeliever. لا يقتل مسلم بكافر

This hadith is supported by the generality of the saying of Allah (Blessed and Exalted is He):
(35) Then will We treat the Muslims like the criminals? (36) What is [the matter] with you? How do you judge? أَفَنَجْعَلُ الْمُسْلِمِينَ كَالْمُجْرِمِينَ * مَا لَكُمْ كَيْفَ تَحْكُمُونَ
