The questioner: May Allah preserve you, O honorable father, is it permissible to swear by the Qur'an... I ask for clarification, and may Allah reward you with good?
The Shaykh: Repeat the question.
The questioner: Is it permissible to swear by the Qur'an... I ask for clarification.
The Shaykh: There is no doubt in the permissibility of swearing by the Noble Qur'an according to the methodology of the people of the Sunnah and the community; because the Qur'an is the speech of Allah (Blessed and Exalted is He). As for those who say, like the Mu'tazilah and others who claim affiliation with the people of the Sunnah and the community as we mentioned earlier; among them are those who belong to the Asha'irah or the Maturidiyyah who do not say that the speech of Allah (Mighty and Majestic) is an attribute of His attributes. So whoever holds the belief of the people of hadith and the belief of the Salaf that the Qur'an is the speech of Allah and is not created, then if he swears by the speech of Allah, he has sworn by an attribute of the attributes of Allah that is eternal. As it came in some authentic hadiths that some of those who are taken out—meaning: whom Allah Mighty and Majestic takes out—of the Fire in a long hadith I do not recall now, swears and says: By Your Majesty, O Lord of the worlds.
And closer to this as an example is what is mentioned regarding Imam Ahmad that he used to argue that it is not permissible to seek refuge in the created; because it is established from the Prophet (peace and blessings be upon him) that he used to say:Sunan Abi Dawud 3899Da'if in chain (Al-Albani). So when the perfect words of Allah are an attribute of His attributes, it is permissible to seek help with them, and consequently it is permissible to swear by them, and it is not permissible to swear by anything else of the created things. So this is clear evidence that the speech of Allah is not created as the Mu'tazilah and those who support them in their belief say. It is permissible for the Muslim to swear by the Noble Qur'an, but here is a fine point that must be noted; the Noble Qur'an—as we mentioned earlier—is an attribute of the attributes of Allah (Mighty and Majestic); because it is His speech. But the mushaf which is made of leather and paper, where the Qur'an is recorded; this mushaf is not permissible to swear by except by a weak interpretation; that the one swearing by the mushaf means the speech of Allah that is in it. So it is better that the Muslim swears by the Qur'an and does not swear by the mushaf; because the mushaf contains something created. So at that time, his swearing by the mushaf means swearing by the speech of Allah from one aspect, and by something of the creation of Allah from another aspect. We should note this. So if one of us swears, let him swear by the speech of Allah and not by the mushaf; because the mushaf is created, it is of leather and paper and so on. And were it not that it contains the speech of Allah (Mighty and Majestic), it would have no value except the value of the paper on which it is written and from which benefit is derived. So this difference must be noted. As for swearing by the speech of Allah (Mighty and Majestic), it is a prescribed oath, and whoever breaks it; upon him is an expiation as if he said: By Allah, and by Allah...
