Is it prescribed in Islam to divide the mahr (bridal gift) of a girl or fiancée into two parts, an immediate portion and a deferred portion?

Machine translationRead the Arabic original
The Shaykh : So let us correct the question and say: Is it prescribed in Islam to divide the mahr (bridal gift) of a girl or fiancée into two parts, an immediate portion and a deferred portion?
We say, and having answered: This is if it is not feasible for him, but what is feasible must be paid immediately. Why?
Because of the saying of Allah the Exalted:
And hasten to forgiveness from your Lord and a garden as wide as the heavens and earth وسارعوا إلى مغفرة مِن ربكم وجنة عرضها السماوات والأرض
[Ali 'Imran 3:133]
: Hasten to your Lord, meaning: with righteous deeds. Otherwise, our Lord is not sitting on top of a mountain or at the end of a plain for us to hasten in walking toward Him; rather, we hasten to His obedience so that we may enter His Paradise on the Day of Resurrection. The deferred mahr is for a time when there is no system in Islam, but rather it is a necessity or a pressing need. Therefore, the jurists mention that if a man proposes to a woman and does not set a mahr for her, she is entitled to the mahr of her peers, meaning later on. But as a system of an immediate mahr and a deferred mahr, there is no basis for it in Islam; rather, as we said, it is either for a pressing need or a necessity.
Moreover, this system becomes not only a matter that was imposed and innovated in the religion, and our Messenger says:
'A'isha reported Allah's Messenger (ﷺ) as saying: He who innovates things in our affairs for which there is no valid (reason) (commits sin) and these are to be rejected. مَن أحدث في أمرنا هذا ما ليس منه فهو رد
Sahih Muslim 1718a
. Not only is this its harm, but there are harms that some who scrutinize these violations can feel. Perhaps many of you have shared this observation with us, which is: Often, the spouses do not agree on good cohabitation after the experience of one or two years, less or more, and so on. The man is then forced to divorce her and replace her with someone else whom he thinks is better than her. But there is a constraint placed around his neck, which is the deferred mahr. And among the corruption of this system followed in these days is that the girl's guardian is convinced to make the immediate mahr nominal, symbolic, and very small, while at the same time multiplying the deferred portion many times over. So when the time of separation comes, he will not be able to part with her, because he faces one of two things:
If he cannot fulfill it, it is imprisonment and jail. And if he can fulfill it, he returns and his hand is in the ground, as he (peace and blessings be upon him) said:
so you should choose one with religion. May your hands cleave to dust. عليك بذات الدين ترِبت يداك
Sahih Muslim 715d
. So among the corruptions of making this system of dividing the mahr into immediate and deferred is that it corrupts the marital relationship between the two and makes them among those who live a life in hell and cannot part with each other for the reason we mentioned earlier.
Whereas if originally the mahr was paid, little or much, and then life with her did not please him, at the very least due to the lack of moral compatibility, as came in some authentic hadiths: That a man from the Companions—I have forgotten his name now—married a woman, and after a period she came to complain about her husband to the Prophet (peace and blessings be upon him) and asked him to separate her from her husband. She said:
By Allah, O Messenger of Allah, I do not complain of anything from him regarding religion or character والله يا رسول الله ما أشكو منه من دين أو خلق
I do not complain of anything from him, but the matter is long because there is no compatibility or agreement, there is distance in morals, and no blame regarding sexual intercourse, sometimes there is no agreement between the spouses. So they will live in a life of hell. For that reason, divorce was wise to untie this problem that the spouses may face. Therefore, the one who married with a deferred mahr cannot divorce, and thus the wisdom of the Shari'ah regarding divorce is lost for him. For this reason, we say: The best guidance is the guidance of Muhammad (peace and blessings be upon him). So whoever marries, it is obligatory for him to pay the mahr in advance, however much it is, if he is able. And if he is not able, let him pay what he can. And if he does not find the religious woman, let him pay what is facilitated for him and let him intend with himself to pay the deferred portion not at the end of the term, but as it becomes facilitated for him. This is my answer to this.
