The questioner : A questioner says, and a questioner says, rather a questioner says: O honorable Shaykh, this is my mother, who is in distress because she became pregnant in the sixth month and was ill due to the pregnancy of the fetus. She was admitted to the hospital and discharged, and they said: If the fetus is ill, it will come down. So she went to one of the women and had her cauterized, because the women around her said: Get cauterized. If the fetus is ill, it will come down, and if it is healthy, it will remain. Then she ate, he says she ate a specific type, she ate gum arabic starch or drank it, so the fetus fell, cried for about five minutes, and then died. My mother is confused. And she was very ill until the fetus came down. Is there any blame on her? And is there any sin on her for that?

The Shaykh : Yes, there is blame on her, then blame, then blame, and sin, then sin, then sin, because if the fetus reaches four months, it cannot be expelled under any circumstances, even if its mother perishes, let it be. Because the human being, as came in the hadith of Abdullah ibn Mas'ud from the Prophet (peace and blessings be upon him):
every one of you is collected in the womb of his mother for the first forty days, and then he becomes a clot for another forty days, and then a piece of flesh for another forty days يجمع الخلق في بطن أمه أربعين يوماً نطفة ثم يكون علقة مثل ذلك، ثم يكون مضغة مثل ذلك
Sahih al-Bukhari 3332
How long is this? Forty and forty and forty. How many months is that? Four months,
Then an angel is sent to it and breathes into it the soul ثم يبعث إليه ملك فينفخ فيه الروح
. And when the soul is breathed into it, it cannot be expelled under any circumstances, because if it were expelled, this would mean killing a soul without right.
If someone says: If it remained in its mother's womb, she would perish, and if she perishes, it would perish.
The answer is: First, if the mother perishes, the fetus may not perish if there is someone with her to perform the operation immediately and bring out the child. It may be saved, meaning: its death is not certain.
Second, if it happens that the mother died, did she die by our action? Answer, everyone. No, this is from Allah (Mighty and Majestic). But if we expelled the fetus and it died, then it died by our action, and this is not permissible. This woman must now fast two consecutive months. As for the issue of blood money, that is between her and the heir of the fetus, and we do not speak of it. But the expiation is on her, an expiation that she fasts two consecutive months. If she says: She is unable to do so, then there is nothing on her, because Allah the Exalted did not mention an alternative to fasting the two months in killing. So if she is unable to perform the obligatory, it is dropped from her.
