The questioner : He performed Hajj in the year 98 of the Qaw'iyyah era with the owner of a car, but the car owner was ignorant of the rites of Hajj regarding the routes, and unfortunately, we spent the three days of Mina in al-Hawd in Makkah and stayed the nights of Mina in this place, and we slaughtered our sacrificial animals. Is there anything required of us in this, given that it was not possible for us to reach Mina? I ask that this problem be presented to one of the honorable scholars: what is the expiation required of us? And is it waived from us? May Allah guide everyone to what is good, happiness, and success.

The Shaykh : As for their slaughtering the sacrificial animals there, there is no harm in it, for it is permissible to slaughter in Mina, it is permissible to slaughter in Makkah, and it is permissible to slaughter in all areas of the Haram. As for their staying in that place for the three days, if the matter is as described and they were unable to reach Mina, then there is nothing required of them in that. However, if they were negligent and did not search or investigate this matter, then they have committed a great error. It is obligatory for the Muslim to be cautious with his religion and to search until he is certain of his inability. Once inability is confirmed, Allah (Glorified and Exalted is He) does not burden a soul beyond its capacity. The scholars have stated, based on this noble verse, that there is no obligation in the case of inability.
