Ruling on staying outside Mina during the days of Mina

What is your opinion regarding people who go for Hajj every year, but they stay outside the boundaries of Mina seeking comfort so that their car is right next to them, even though if they entered Mina they would find places, but they are rough on the mountains or such? What do we say to them?

Say to these people: Those who stay outside Mina while it is possible to stay in Mina are sinful and transgressing the limits of Allah; because it is obligatory for the pilgrim to be in Mina, unless he does not find a place, for Allah the Exalted says in His Book:
Allah does not charge a soul except [with that within] its capacityلا يُكَلِّفُ اللَّهُ نَفْساً إِلَّا وُسْعَهَا
[al-Baqarah: 286] ,And he says:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[al-Taghabun: 16] .
The Prophet (peace and blessings be upon him) granted a dispensation to his uncle al-Abbas to leave the overnight stay in Mina during the nights of Mina; for the sake of providing water to the pilgrims.
So whoever is unable to do so is even more deserving of being excused.
As for them, they are able;But they say: We want comfort,So I advise them to a comfort greater than this: To remain in their homes so that they do not have to bear the hardship of travel, expenses, and parting from their families.
And Hajj necessarily involves hardship; because it is jihad, as the Prophet (peace and blessings be upon him) said when Aisha asked him: (Is there jihad for women?He said: Yes,Jihad without fighting: Hajj and 'Umrah) .

And Allah the Exalted said:
And spend in the way of Allah and do not throw [yourselves] with your [own] hands into destruction [by refraining]. And do good; indeed, Allah loves the doers of good.وَأَنْفِقُوا فِي سَبِيلِ اللَّهِ وَلا تُلْقُوا بِأَيْدِيكُمْ إِلَى التَّهْلُكَةِ وَأَحْسِنُوا إِنَّ اللَّهَ يُحِبُّ الْمُحْسِنِينَ
[al-Baqarah: 195]
And complete the Hajj and 'umrah for Allahوَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ
[al-Baqarah: 196] .
So his mention of completing Hajj and 'Umrah for Allah after spending in the cause of Allah indicates that it is a type of jihad, and it is so.
