Departing from Muzdalifah after midnight: the reports (athar) concerning this.

Machine translationRead the Arabic original
The questioner : Departing from Muzdalifah after midnight, the reports (athar) that state it is in the last part of the night, and when the moon sets at dawn, but the word...

The Shaykh : Pardon me, it is not in the last part of the night, but after midnight.

The questioner : So, is there a specific text (nass) in the Sunnah regarding after midnight?

The Shaykh : Yes, that is correct. I think Umm Salimah used to say to her servant, "Look, has the moon set?" She would say, "No." Until she said, "Yes," and then she departed. She stated that the Prophet (peace and blessings be upon him) had permitted the women to depart from Muzdalifah after midnight. Nevertheless, let us listen to you: what is the outcome of the disagreement between the two phrasings? Between the women departing after midnight, or departing in the last part of the night; what is the outcome of the disagreement, if there is one?

The questioner : The outcome of the disagreement—O honorable...The Shaykh : ...the moon does not set until after two-thirds of the night have passed, on the night of the tenth.

The Shaykh : In any case, it is after half the night, not in the last part of the night, so the disagreement is verbal; but what is the outcome?

The questioner : If we say it is in the last part of the night, half the night is not part of the last part of the night.

The Shaykh : After half the night, I am saying, not half the night.

The questioner : Yes, may Allah reward you with good.

The Shaykh : Fine, so with that, let us continue. What if we depart in the second third of the night? What is there beyond that regarding what we mentioned earlier? Is it just your observation on this specific word, or is there something else?!

The questioner : I understood it—though my understanding was wrong—I understood it as half the night.

The Shaykh : After half the night.

The questioner : May Allah reward you with good.

The Shaykh : And you, yes. Please, go ahead.
