The questioner: His EminenceThe Shaykh- May Allah preserve you - I heard that you say that the witr is made up as witr; that is: if a man prays three rak'ahs of the night prayer and does not pray them at night, he makes them up the next day with the same number of rak'ahs; that is: three rak'ahs, and not four rak'ahs. And there is a hadith in "Sahih Muslim" to the effect that the Messenger of Allah (peace and blessings be upon him) used to make up the night prayer as twelve rak'ahs; so what is the evidence for making up the witr as witr? I ask for clarification, and may Allah reward you with good?

The Shaykh: The evidence is his saying (peace and blessings be upon him):
If any of you forgets the witr or sleeps through it, let him pray it when he remembers it, or when he wakes up for it إذا نَسِيَ أحدكم الوتر أو نام عنه ؛ فليصلِّه حين يذكره ، أو حين يستيقظ له
. The Prophet (peace and blessings be upon him and his family) treated the witr in the same way as he treated the obligatory prayer. So the hadith narrated in "the two Sahihs" with the wording:
If a man forgets a prayer or sleeps through it, let him pray it when he remembers it; there is no expiation for it except that من نَسِيَ صلاةً أو نام عنها ؛ فليصلِّها حين يذكرها ، لا كفارة لها إلا ذلك
; so if a man sleeps through the witr or forgets the witr, his ruling is the ruling of the obligatory prayer that he slept through or was negligent about. So in that case, he prays the witr at the time of remembering it or the time of waking up. As for the hadith mentioned and attributed to "Sahih Muslim," even though it is authentic and from his action (peace and blessings be upon him), there is no contradiction between the hadith that I mentioned and this hadith; because this does not apply to one who forgot or slept, but rather to one for whom it was not possible to pray the night prayer; so in that case, he compensates for what he missed of the night prayer, not by the excuse of sleep and forgetfulness, but because it was not possible for him to do so; so he may pray twelve rak'ahs during the day.
