I do not know this hadith. Whether the hadith is authentic or not, the legal ruling does not need to rely on this hadith, of which the least we can say is that we do not know its authenticity now. This is because it is established from the Messenger (peace and blessings be upon him and his family) in *Sahih*—and I mean *Sahih Muslim*—that he entered his mosque one day, smelled the odor of garlic from a man in it, and ordered him to be taken out of the mosque, and he was not a hypocrite. If a Muslim society were found that is like the society today, first, there is no one to apply this ruling, and second, if we wanted to apply it, the mosque would be left with only a few individuals. Therefore, applying such a ruling requires a judgment; a judgment based on the Book and the Sunnah. For this reason, we say: before you think about such matters that one of us feels require authority, as Uthman said, “Indeed, Allah restrains by authority what the Qur’an does not restrain,” it requires an authority that judges by the Qur’an, not a person who speaks and says: this is forbidden and this is lawful.
