Is it permissible to pray in it?The Shaykh: In a case like this, if it is established that it belongs to a certain person and a mosque has been built on it, what I see is that the landowner should be reconciled by estimating the value of his land and giving it to him. It is not possible to demolish the mosque after it has been built and large expenses have been incurred on it. It is obligatory that this man, since the land has been established as his, be reconciled by the generous people.

The questioner: The case has been going on for about eight years, and the landowner is known to be one who will not concede no matter what happens. Is it permissible to pray in it, or not?The Shaykh: What should be done is not to pray in it. However, as long as the government has decided to build this mosque and made it for the Muslims, if he prays in it, there is no blame on him. But it is better not to pray in it.
