The Ruling on the Expiation for One Who Kills a Person by Mistake and Then Dies
There were two people involved in an accident, and we know that if the driver had survived, the expiation for accidental killing would have been obligatory upon him. The driver passed away, so is there anything that remains upon him regarding the accidental killing?
The one who killed a person by mistake and then died owes nothing; because he was unable to perform the act,And Allah the Exalted said:
Allah does not charge a soul except [with that within] its capacityلا يُكَلِّفُ اللَّهُ نَفْساً إِلَاّ وُسْعَهَا
[Surat al-Baqarah: 286] .
