Q: I am the owner of a car, and an accident occurred in which three passengers died. I asked one of the judges to inform me of what he sees regarding this, and he said: You have the choice in three matters: 1 - Fasting two consecutive months for each of them. 2 - Or freeing a slave for each of them. 3 - Or feeding sixty poor people for each of them. Since I am unable to fast six months or free three slaves, and I want to feed them with money, what is the amount I should pay for each poor person? Please inform us, may Allah reward you.
A: It is obligatory for one who causes accidental killing to perform an expiation other than the blood money, which is to free a believing slave for every forbidden soul. If he is unable to do so, he should fast two consecutive months for every soul. It is permissible for you to fast two consecutive months in this year, and after a period, fast two consecutive months, and after another period as well,
fast two consecutive months. The expiation is not valid by feeding, according to the correct opinion of the scholars; because Allah the Exalted said:
And never is it for a believer to kill a believer except by mistake. And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment presented to the deceased's family [is required] unless they give [up their right as] charity. But if the deceased was from a people at war with you and he was a believer - then [only] the freeing of a believing slave; and if he was from a people with whom you have a treaty - then a compensation payment presented to his family and the freeing of a believing slave. And whoever does not find [one or cannot afford to buy one] - then [instead], a fast for two months consecutively, [seeking] acceptance of repentance from Allah. And Allah is ever Knowing and Wise.وَمَا كَانَ لِمُؤْمِنٍ أَنْ يَقْتُلَ مُؤْمِنًا إِلا خَطَأً وَمَنْ قَتَلَ مُؤْمِنًا خَطَأً فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ وَدِيَةٌ مُسَلَّمَةٌ إِلَى أَهْلِهِ إِلا أَنْ يَصَّدَّقُوا فَإِنْ كَانَ مِنْ قَوْمٍ عَدُوٍّ لَكُمْ وَهُوَ مُؤْمِنٌ فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ وَإِنْ كَانَ مِنْ قَوْمٍ بَيْنَكُمْ وَبَيْنَهُمْ مِيثَاقٌ فَدِيَةٌ مُسَلَّمَةٌ إِلَى أَهْلِهِ وَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ تَوْبَةً مِنَ اللَّهِ وَكَانَ اللَّهُ عَلِيمًا حَكِيمًا

, so feeding was not mentioned in the noble verse, and it is in the context of explanation, so it indicates that the obligatory is freeing a slave, and if he does not find one, then fasting, and there is no expiation by anything else. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
