Ruling on a follower who did not pray Maghrib with the imam joining him in the 'Isha' prayer

Machine translationRead the Arabic original
The questioner: Sometimes, regarding the order of prayer when a traveler prays with a resident, such as when a traveler joins a resident in the 'Isha' prayer without having prayed Maghrib, does he offer 'Isha' before Maghrib if he joins the imam? What is the ruling? The Shaykh: The ruling is not as you said. If a person comes and the imam is in the prayer of 'Isha, and he has not prayed the Maghrib prayer, and he enters with the imam intending Maghrib, let him continue with the imam.

The questioner: Do you mean with the 'Isha' prayer? The Shaykh: The imam prays 'Isha' and the follower prays with him, continuing with him. When the follower completes three rak'ahs, he sits, recites the tashahhud, and says the taslim, then joins the imam in the remainder of the imam's 'Isha' prayer. This is if he joined the imam from the beginning of the prayer.
As for if he joined the imam in the second rak'ah, there is no problem. If he joined the imam in the second rak'ah and intended Maghrib, let him continue with the imam and say the taslim with him; there is no problem here.
And the issue of the tashahhud remains, and there is no problem with it. The tashahhud is missed even in the Zuhr prayer. If you join the imam in the Zuhr prayer in the second rak'ah, you will recite the tashahhud in your first rak'ah and leave off the tashahhud in your second rak'ah, meaning the imam will stand up for the fourth rak'ah.

The questioner: Some people issue a fatwa that one joins the imam by praying 'Isha' and then praying Maghrib? The Shaykh: Yes.
Some scholars hold this view, that you join the imam with the imam's intention,Meaning: the intention of 'Isha', and when you finish, you pray Maghrib.

The questioner: And what is the stronger position, O Shaykh? The Shaykh: The stronger position is the first one, for the sake of order.
