Ruling on Renting a Shop to a Hired Worker

Your Eminence! This is a man who hired a worker and set up a commercial establishment, and he said to the worker: I will rent you this establishment for a monthly fee. What is the ruling on this action?
This action is forbidden,First: because it contradicts the contract that was made between him and this worker.

And secondly: contrary to the government's regulations,and the government's regulations must be followed unless they contradict the Book and the Sunnah, meaning: unless they involve disobedience.

And third: This is a ruse, a ruse to take from him so much each month or so much each year, whether this worker makes a profit or not.

And for this reason we say: If you bring in a worker and you want him to be directly involved in buying and selling in the shop, he is to be paid the wage that was agreed upon. And if you are afraid that he will not be diligent, make him a commission on what he spends,So say, for example: for every thousand riyals he spends, you give him ten riyals or one hundred riyals, and so on. In that case, he will be motivated, and there will be no violation of the government regulations.

The questioner: And the salary, O Shaykh?The Shaykh: And he gives him the full salary. Now, you came to me with seven hundred per month; that is seven hundred. But in addition, as an incentive for you, if you spend a thousand riyals from the shop, for every thousand riyals you spend, I give you one hundred riyals extra on top of the salary.
