The questioner : Your Eminence, this man brought in a worker and opened a commercial establishment. He said to the worker, "I will rent you this establishment for a monthly rent." What is the ruling on this action?

The Shaykh : This action is forbidden. First, because it contradicts the contract made between him and this worker.
Second, it contradicts the government's regulations. The government's regulations must be followed as long as they do not contradict the Book and the Sunnah, or include disobedience.
Third, this is a ruse to take from him a certain amount every month or every year, whether this worker profits or not.
Therefore, we say: if you bring in a worker and want him to be directly involved in selling and buying in the shop, he is on the wage agreed upon. And if you fear that he will not be sincere, make a commission for him on what he spends. Say, for example, "Every time you spend the amount of one thousand riyals, you get ten riyals or one hundred riyals," and so on. In that case, he will be motivated, and there will be no contradiction with the government.
