The Prohibition of Swearing by Other Than Allah
Machine translationRead the Arabic original
At the beginning of the exegesis, we learned that Allah (Mighty and Majestic) swore by His creations, such as the sky and the night,And we find some people swear and say: and by the life of my children,And he says: I divorce, or it is forbidden for me to do such and such, so what is the ruling on that?
As for (and by the life of my children), this is an explicit oath that is not permissible,And this falls under the saying of the Prophet (peace and blessings be upon him): (whoever swears by other than Allah has committed disbelief or associated partners with Allah).
As for: I divorce to do it, so this is not an oath, but it has the ruling of an oath,When he says: It is forbidden for me to drink from this, it is forbidden for me to visit so-and-so, it is forbidden for me to eat this food, it is forbidden for me to slaughter a sacrifice for me.
So this is not an oath in terms of its form, but it is the meaning of an oath,And the evidence for this is the saying of Allah the Exalted: [al-Tahrim:1-2] So Allah named prohibition an oath,As for the ruling, we say: If you say something like this, then expiate for your oath, and that is by feeding ten poor people,And there is no difference between saying: It is forbidden for me to [take] my wife, or I divorce, or it is forbidden for me to do such and such, but in the matter of divorce, if he intended divorce, it takes place if he breaks what he said.
So this is not an oath in terms of its form, but it is the meaning of an oath,And the evidence for this is the saying of Allah the Exalted:
