Ruling on One Who Sells a Shop Before Zakah Becomes Due
His Eminence the Shaykh: A person sold a shop two months before his zakah became due. Who is the one who pays the zakah?
If ownership of the zakatable wealth transfers before the completion of the lunar year, and it is trade goods, just as the first owner possessed them, he purifies it along with his other wealth. An example of that is: A man has land for trade and sells it two months before his zakah becomes due. When the zakah becomes due, it is obligatory for him to pay the zakah on the money for which he sold this land. However, if he sold it for money and then used that money to buy a residence for himself before the completion of the lunar year, he owes no zakah.
As for the second person to whom it transferred,It is considered: Did it transfer to him in a way that makes zakah obligatory, such as if he bought it for trade? In that case, its lunar year is based on the lunar year of the wealth he had before it. If he bought it to build on it and live in it, he owes no zakah.
