His Eminence the Shaykh: Regarding the matter of abrogation, has any part of the Qur'an been abrogated by the Sunnah?
I am not aware of anything in the Qur'an being abrogated by the Sunnah except the issue of the one who commits sodomy—may Allah grant us safety.For Allah the Exalted said in the Qur'an:
And the two who commit it among you, dishonor them both. But if they repent and correct themselves, leave them alone. Indeed, Allah is ever Accepting of repentance and Merciful.وَالَّذَانِ يَأْتِيَانِهَا مِنْكُمْ فَآذُوهُمَا فَإِنْ تَابَا وَأَصْلَحَا فَأَعْرِضُوا عَنْهُمَا إِنَّ اللَّهَ كَانَ تَوَّاباً رَحِيماً
[al-Nisa: 16] This verse indicates that the two who commit it are to be harmed until they repent and reform,Then the Sunnah came: (If you find anyone doing the deed of the people of Lut, kill the active partner and the passive partner) This is cited as evidence that the Sunnah abrogates the Qur'an.
The deed of the people of Lut is greater than zina—may Allah protect us—and more heinous,And the evidence for this is that Allah said in the Qur'an:
And do not approach unlawful sexual intercourse. Indeed, it is ever an immoralityوَلا تَقْرَبُوا الزِّنَى إِنَّهُ كَانَ فَاحِشَةً
[al-Isra: 32] meaning: a heinous act among heinous acts,As for sodomy, Lut said to his people:
Will you commit the immorality?أَتَأْتُونَ الْفَاحِشَةَ
[al-A'raf: 80] meaning: the greatest and most major heinous act. This is why the definite article (al) was used with it. Thus, sodomy is greater than zina. This is indicated by the fact that Allah, Glorified and Exalted is He, sent a Messenger with a complete message to warn against this abominable deed, and that Allah destroyed the doers of this abominable deed in general. This indicates that sodomy is greater than zina. Therefore, it is obligatory for the one in authority, if sodomy is established between two adults of sound mind, and neither was coerced, that he must kill them in obedience to the command of the Prophet (peace and blessings be upon him), and to avert this ugly harm and heinous act. May Allah grant us safety.
This is what comes to my mind after looking into the abrogation of the Qur'an by the Sunnah.

As for the one who said: The statement that the saying of Allah the Exalted:
Prescribed for you when death approaches [any] one of you if he leaves wealth [is that he should make] a bequest for the parents and near relatives according to what is acceptable - a duty upon the righteous.كُتِبَ عَلَيْكُمْ إِذَا حَضَرَ أَحَدَكُمُ الْمَوْتُ إِنْ تَرَكَ خَيْراً الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالْأَقْرَبِينَ بِالْمَعْرُوفِ حَقّاً عَلَى الْمُتَّقِينَ
[al-Baqarah: 180] is abrogated by the saying of the Prophet (peace and blessings be upon him): (There is no bequest for an heir) is a statement that is not correct. First: because the hadith does not contain abrogation, but rather specification; because the verse contains the command to make a bequest to the close relatives, which includes the heir and the non-heir. Then the ruling was lifted only for the heir. This is specification, not abrogation; because abrogation is the lifting of the ruling in its entirety, not the lifting of the ruling from some of the individuals of a general statement.

Second: That the hadith is an explanation of the abrogating text, not an abrogating text itself;Because the Messenger of Allah (peace and blessings be upon him) said: (Indeed, Allah has given every one who has a right his right, so there is no bequest for an heir) This indicates that the Prophet (peace and blessings be upon him) explained that Allah the Exalted has divided the inheritance and given every one who has a right his right, so there is no bequest for an heir after this division.
But let it be known to you that even if no example is found that is free from objection, the Sunnah, if it is authentic from the Prophet (peace and blessings be upon him), is in the position of the Qur'an. It is obligatory to act upon what is in it and to believe its report.
