His Eminence the Shaykh: A Hindu man who is married has embraced Islam, while his wife remains Hindu in their country. He has taken a leave of absence and agreed with his supervisor to bring her here in order to invite her to Islam. Is it permissible for him to satisfy his desire with her during his leave without informing her of his Islam? Please issue a ruling, may Allah reward you.
It is not permissible for this Muslim man to take pleasure from her unless she embraces Islam. It is obligatory for him to first offer her Islam. If she embraces Islam, she is his wife. If she does not embrace Islam, she is not his wife, and it is not permissible for him to take pleasure from any part of her, because she is forbidden to him.Allah, Blessed and Exalted, said:
And if you know them to be believers, then do not return them to the disbelievers; they are not lawful [wives] for them, nor are they lawful [husbands] for themفَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ لا هُنَّ حِلٌّ لَهُمْ وَلا هُمْ يَحِلُّونَ لَهُنَّ
[Al-Mumtahanah: 10] Therefore, it is obligatory for him not to approach her, meaning: he must not have physical contact with her or take pleasure from her. Rather, he should speak to her about Islam, about the virtues of Islam, and encourage her gradually.
