The ruling on one who commits a prohibited act while ignorant, forgetful, or coerced
These prohibited acts have a penalty and a ransom payment known to the jurists, but what concerns us is knowing that if a person commits these prohibited acts while forgetful, ignorant, or coerced, he owes nothing: no sin, no invalidation of his pilgrimage, no tax, and no ransom payment. If a person does so while forgetful, ignorant, or coerced, he owes nothing.
So if a person forgets and covers his head, he owes nothing; but if he remembers, he must remove the covering from his head.
And if he applies perfume while forgetful and then remembers, he owes nothing; but he must wash off the perfume.
And if he touches his wife while forgetful, he owes nothing; and if he has intercourse with her while forgetful, he owes nothing. And if a man coerces his wife, who is in the state of ihram, and she has intercourse with him, she owes nothing.
The important thing is that the basic principle in the Islamic Shari'ah is: that one who commits the prohibited acts while forgetful or coerced owes nothing,The evidence: His saying, the Exalted: [al-Baqarah: 286] , (so Allah the Exalted said: I have done so) .
And Allah the Exalted said: [al-Ahzab: 5] .
