Prohibitions of Ihram.
Machine translationRead the Arabic original
The Shaykh : As for the prohibitions of Ihram, we mention from them what has come in the Qur'an and the Sunnah:
From what has come in the Qur'an is the saying of Allah the Exalted:[Al-Baqarah 2:197] And al-Rafath is intercourse, so intercourse is forbidden for a person from the time he enters Ihram until he performs the second removal of restrictions, and it is the greatest of the prohibitions.
The second is ejaculation through direct contact, or through self-stimulation, or through repeated looking.
The third is direct contact, even if there is no ejaculation and no intercourse, because it is one of the preliminaries to intercourse, and one cannot be certain that a person will engage in direct contact first and then follow it with intercourse.
The fourth is contracting marriage, so it is not permissible to—let it go, let it go—the fourth is contracting marriage, because the Prophet (peace and blessings be upon him) said:Sunan Abi Dawud 1841Sahih (Al-Albani)
The fifth is the proposal of marriage, for it is forbidden because of the saying of the Prophet (peace and blessings be upon him):
The sixth is perfume, because of the saying of the Prophet (peace and blessings be upon him) regarding the one who died and his mount fell on him: meaning: do not put perfume on him.
The seventh is shaving the hair of the head, because of the saying of Allah, Blessed and Exalted is He:[Al-Baqarah 2:196]
The eighth is wearing what the Prophet (peace and blessings be upon him) explicitly forbade, where
The ninth is a woman wearing gloves, because the Prophet (peace and blessings be upon him) forbade that, and likewise a man does not wear gloves, because they are of the same kind as the turban and its like; the turban is a covering for the head, whereas gloves are a covering for the hands.
The tenth is leather socks for men only, except for one who does not find sandals, in which case he wears the leather socks. The sixth is covering the head, because of the saying of the Prophet (peace and blessings be upon him) regarding the one who died at 'Arafah: These prohibitions have, yes.
The eleventh is killing game, because of the saying of Allah the Exalted:[Al-Ma'idah 5:95] These prohibitions have a known expiation and ransom according to the jurists, but what concerns us is that we know that if a person commits these prohibitions while forgetting, or being ignorant, or being coerced, then he owes nothing: no sin, no invalidation of his worship, no blood money, and no ransom. If a person does so while forgetting, or being ignorant, or being coerced, he owes nothing. So if a person forgets and covers his head, he owes nothing, but when he remembers, he must remove the covering from his head. If he applies perfume while forgetting and then remembers, he owes nothing, but he must wash off the perfume. If he engages in direct contact with his wife while forgetting, he owes nothing. If he has intercourse with her while forgetting, he owes nothing. If a man coerces his wife while she is in Ihram and has intercourse with her, she owes nothing.
The important thing is that the basic rule in the Islamic Shari'ah is that whoever commits the prohibitions while forgetting, or being coerced, owes nothing. The evidence is the saying of Allah the Exalted:[Al-Baqarah 2:286] And He said: [Al-Ahzab 33:5] And He said: [An-Nahl 16:106] And if coercion to disbelief, which is the greatest of sins, has its ruling lifted from the servant, then what is less than it is all the more so. And in the hadith from the Prophet (peace and blessings be upon him): Sunan Ibn Majah 2043Sahih (Darussalam).
This is a brief overview of Hajj, its obligations, its pillars, and its prohibitions. Whoever wants to expand on that, praise be to Allah, the books are available and the small books of rituals are available, so let him refer to them. We limit ourselves to this extent so that we can devote ourselves to the questions. We start with al-Ayyam, what is it? Yes, yes.
The questioner : In the name of Allah.
Your Eminence, may Allah preserve you, in the hadith of 'Abd al-Qays, the prohibition of four things is mentioned, among which is al-Muzaffat.
The Shaykh : Leave it for later; this has no benefit. And today, the questions are only about what relates to Hajj.
The questioner : Fine, may Allah reward you, if Allah wills.
The Shaykh : No, the arrivals before, that is enough... these are from the students.
From what has come in the Qur'an is the saying of Allah the Exalted:
Hajj is [during] well-known months, so whoever has made Hajj obligatory upon himself therein [by entering the state of ihram], there is [to be for him] no sexual relations and no disobedience and no disputing during Hajj. And whatever good you do - Allah knows it. And take provisions, but indeed, the best provision is fear of Allah. And fear Me, O you of understanding.
The fourth is contracting marriage, so it is not permissible to—let it go, let it go—the fourth is contracting marriage, because the Prophet (peace and blessings be upon him) said:
A pilgrim may not marry and give someone in marriage in the sacred state(while wearing ihram).
The fifth is the proposal of marriage, for it is forbidden because of the saying of the Prophet (peace and blessings be upon him):
Nor does he propose marriage
The sixth is perfume, because of the saying of the Prophet (peace and blessings be upon him) regarding the one who died and his mount fell on him:
Do not apply perfumed ointment to him
The seventh is shaving the hair of the head, because of the saying of Allah, Blessed and Exalted is He:
And do not shave your heads until the sacrificial animal has reached its place of slaughter
The eighth is wearing what the Prophet (peace and blessings be upon him) explicitly forbade, where
He was asked: What does the one in Ihram wear? He said: He does not wear the shirt, nor the trousers, nor the turbans, nor the hooded cloaks, nor the leather socks.
The sixth is covering the head, because of the saying of the Prophet (peace and blessings be upon him) regarding the one who died at 'Arafah:
Do not cover his head.
The eleventh is killing game, because of the saying of Allah the Exalted:
O you who have believed, do not kill game while you are in the state of ihram.
The important thing is that the basic rule in the Islamic Shari'ah is that whoever commits the prohibitions while forgetting, or being coerced, owes nothing. The evidence is the saying of Allah the Exalted:
Our Lord, do not impose blame upon us if we have forgotten or erred.
So Allah the Exalted said: You have done it.
And there is no blame upon you for that in which you have erred but [only for] what your hearts intended
وَلَيْسَ عَلَيْكُمْ جُنَاحٌ فِيمَا أَخْطَأْتُمْ بِهِ وَلَكِنْ مَا تَعَمَّدَتْ قُلُوبُكُمْWhoever disbelieves in Allah after his belief... except for one who is forced [to renounce his religion] while his heart is secure in faith. But those who [willingly] open their breasts to disbelief, upon them is wrath from Allah, and for them is a great punishment;
Allah has forgiven for me my nation their mistakes and forgetfulness, and what they are forced to do.
