The Expiation for an Oath When the Person Sworn Upon Disobeys
Machine translationRead the Arabic original
What is the ruling on the expiation if a person swears to compel another person,Meaning: forcing him and swearing by Allah that he will sit with him, but this person refuses, whether with an excuse or without one, and this happens often?
First, we say to the person: Do not swear; because this puts your brother in a difficult position, either he fulfills your oath under compulsion, or he causes you to break your oath. So if you did swear, we say to the person sworn upon: Fulfill your brother's oath; because it is the right of a Muslim over another Muslim to fulfill his oath. If he did so for an excuse, he is not to be blamed, and if he did so without an excuse, he is to be blamed.
As for the one who swore, it is obligatory for him to pay the expiation for the oath whenever the person sworn upon disobeys him, in all cases.
