Your Eminence! Are the oaths of disbelievers generally accepted? Or are they not accepted except from the People of the Book only?
The Prophet (peace and blessings be upon him) said: (The proof is on the claimant, and the oath is on the one who denies) This is general, and in disputes, the disbeliever and the Muslim are equal, as are the one from the People of the Book and the one who is not.For this reason, even if we assume two men: One of them is a Muslim and the other is a disbeliever, and they come to a judge to dispute. It is not permissible to give the Muslim precedence over the disbeliever; rather, he must place them both before him equally, even in entering.He does not say to the Muslim: If the Muslim enters before the disbeliever, the judge should leave the order of entry up to them. If one enters before the other, there is no blame on him for it. Therefore, he must seat them both before him on an equal footing, in looking at them, and in facing them; it must be equal in this as well, because this is a ruling, and justice is obligatory in a ruling.Allah the Exalted said: [Al-Ma'idah: 8] .
