Allah, Blessed and Exalted, said: (In the name of Allah, the Entirely Merciful, the Especially Merciful) The Basmala is a verse from the Book of Allah that was revealed at the beginning of every surah, except for the surah of al-Bara'ah, for which it was not revealed to serve as a separator between it and the surah of al-Anfal. For this reason, it was not written in the mushaf, and it is not part of the surah with which it begins. Thus, it is not part of al-Fatihah, contrary to what we observe in the mushafs, where it is counted as part of al-Fatihah for the sake of timing.
And the correct view is that it is not part of al-Fatihah, and that the first verse in the surah of al-Fatihah is the saying of Allah the Exalted:
[All] praise is [due] to Allah, Lord of the worlds -الْحَمْدُ لِلَّهِ رَبِّ الْعَالَمِينَ
[al-Fatihah: 2] And there is evidence for this in the verbal and practical Sunnah. As for the verbal, what is established in the authentic collections from the hadith of Abu Hurayrah (may Allah be pleased with him) from the Prophet (peace and blessings be upon him) that Allah said: "I divided the prayer between Me and My servant in two halves: So when he says: (Praise is to Allah, Lord of the worlds) Allah says: My servant praised Me,And when he said: (The Entirely Merciful, the Especially Merciful) He said: My servant praised Me,And when he said: (Master of the Day of Recompense) He said: My servant glorified Me,And when he said: (You alone we worship and You alone we ask for help) He said: This is between Me and My servant, and My servant gets what he asked for,When he says: (Guide us to the straight path) (The path of those upon whom You have bestowed favor, not of those who have evoked [Your] anger or of those who are astray) Allah said: This is for My servant, and My servant gets what he asked for."

And as for the practical Sunnah: So, the Prophet (peace and blessings be upon him and his family) would not recite "In the name of Allah, the Entirely Merciful, the Especially Merciful" aloud during the night prayer, but he would recite al-Fatihah aloud. This indicates that it is not part of al-Fatihah, and this is the stronger opinion.

Allah, Blessed and Exalted is He, says: (In the name of Allah, the Entirely Merciful, the Especially Merciful, And the Mount, * And a written book, * In a spread-out parchment, * And the Adorned House, * And the raised canopy, * And the bound sea [al-Tur: 1-6] .
These are things by which Allah swore,The first: al-Tur; and it is the mountain upon which Allah spoke to Musa ibn 'Imran (peace be upon him). For Allah the Exalted first spoke to him upon the Mount of Tur, so this mountain attained a status and virtue that surpassed other mountains. For this reason, many scholars stated that it -Meaning: the Mount of Tur - is the best and most noble of mountains. On this basis, it would be more noble and better than Mount Hira, where revelation began for the Messenger of Allah (peace and blessings be upon him and his family). This is the apparent meaning of the statement of many scholars. However, there is a consideration regarding this statement; because the Messenger (peace and blessings be upon him) was spoken to upon Hira, but it was Jibril who spoke to him as a messenger from Allah. From it began the best of the messages to the best of the messengers. Also, Hira is within the Makkah sanctuary; because it is part of the sanctuary where hunting is not permitted, nor is cutting trees. And the area of the sanctuary is the best of areas. And the statement of many scholars can be understood in this way, and it can be said: except for Mount Hira.
