On the eleventh day, the night of the eleventh, people are staying in Mina, and staying in Mina is obligatory; because the Prophet (peace and blessings be upon him) only granted a dispensation to those with valid excuses, such as water carriers and shepherds, to leave off staying overnight in Mina. He granted a dispensation to his uncle al-Abbas to descend to Makkah to take charge of providing water—providing water to the people from Zamzam—and this is a public benefit. He granted a dispensation to the shepherds—the shepherds of the pilgrims' camels—not to stay overnight in Mina but to stay in their pastures; because they are occupied with a public benefit. This indicates that others do not have a dispensation. And some people’s negligence regarding staying overnight in Mina has absolutely no basis. So whoever wants the Sunnah and the accepted Hajj, let him adhere to what the Messenger of Allah (peace and blessings be upon him) did.
On the eleventh day, people throw the pebbles at the pillars after the sun has passed its zenith; because the Prophet (peace and blessings be upon him) did not throw them except after the sun had passed its zenith. It is not permissible to advance the throwing on the days of Tashreeq before the sun passes its zenith, because the Prophet (peace and blessings be upon him) threw after the sun passed its zenith,And he said: (Take your rites from me) And if throwing before the sun passes its zenith were not valid, he would have granted a dispensation to the weak and women to throw before the sun passes its zenith, just as he granted them a dispensation to throw before the sun rises on the day of Eid. And if it had been permissible—I mean: to throw before the sun passes its zenith—the Prophet (peace and blessings be upon him) would have done it; because throwing before the sun passes its zenith is easier for people than throwing after the sun passes its zenith.
So throwing after the sun passes its zenith means: Waiting for the heat to become intense, and this is difficult for people. So if throwing in the morning had been permissible, it would have been easier for the Ummah. So when the Messenger of Allah (peace and blessings be upon him) left it and waited until the sun passed its zenith, we know that throwing before the sun passes its zenith is not from the way of the Prophet (peace and blessings be upon him),And the Prophet (peace and blessings be upon him) said: (Whoever does an action that is not in accordance with our command, it is rejected).
And it indicates to you that throwing before the sun passes its zenith is not valid, that the Prophet (peace and blessings be upon him) used to wait—Meaning: waiting until the sun passes its zenith—and from the time the sun passes its zenith, he throws before he prays the midday prayer. So it is as if he is waiting—as they say—with impatient eagerness for the sun to pass its zenith so that he can throw.
And do not be deceived by the permissibility granted by some scholars based on no legal principle. And if we wanted to take an absolute permissibility, we would say: All the days of Tashreeq are a place for the remembrance of Allah the Exalted and Majestic, so throw whenever you wish. But these are specific matters [al-Baqarah: 203] of the remembrance of Allah in the counted days: throwing the pebbles at the pillars,Do we take the absolute meaning of the verse and say: whenever you wish, throw?
No, because the command to remember here is absolute, and the Sunnah specified it, so do not be deceived.But if someone says: If you say: It is not possible to throw except after the sun passes its zenith, and the pilgrims reach one million and five hundred thousand, how is it possible for these people to throw between the sun passing its zenith and the setting of the sun? This is very difficult; because if you divide this number by this time, you will find that one must throw at such and such minute of the hundred, or something like that?We say: The matter is broad, and praise be to Allah. You can throw after the setting of the sun until the dawn of the second day appears. And throwing after the setting of the sun, if it is performance, then it is performance;Because many scholars say: that throwing on the days of Tashreeq is from the sun passing its zenith until the dawn of the second day appears. And if we say that it does not extend to the night and that it ends with the setting of the sun, we say: Throwing after the setting of the sun is making up for a missed act.
