Intellect: Therefore, Hajj is not obligatory upon the insane person, nor is it valid from him; because he has no intention, and it is not valid for his guardian to intend it on his behalf; because that has not been transmitted.

Intellect: The insane person is not obligated to perform Hajj, nor is it valid from him; because he has no intention, and it is not valid for his guardian to intend it on his behalf; because that has not been transmitted. The original ruling in acts of worship is prohibition until evidence establishes their prescription. But how can it be conceived that he is among those upon whom it is obligatory while he is insane?Meaning: How can Hajj be obligatory upon him in a state of insanity? We say: It is possible that this insane person is an adult, and then he acquires wealth from inheritance or otherwise, thereby becoming able to perform Hajj. However, his insanity prevents it from becoming obligatory upon him, so it is not obligatory upon him. Even if he dies while in his state of insanity and leaves behind a great deal of wealth, Hajj is not obligatory for him from it, because it was not originally obligatory upon him.
