The Shaykh : Does an elderly woman who has stopped menstruating, or more precisely, a woman who has stopped menstruating, whether due to old age or a procedure such as a hysterectomy, get divorced immediately, or not?
Yes, she is divorced immediately, even if her husband has had intercourse with her. And she observes her waiting period for how long? For three months, based on the saying of Allah the Exalted:
And those who no longer expect menstruation among your women - if you doubt, then their period is three months, and [also for] those who have not menstruated واللائي يئسن من المحيض من نسائكم إن ارتبتم فعدتهن ثلاثة أشهر واللائي لم يحضن
[At-Talaq 65:4]
meaning, and those who have not menstruated, their waiting period is three months. How many categories of women are these? Four, or three, or two, or five? Three: the pregnant woman, the young girl who has not yet menstruated, and the woman who has stopped menstruating, whether due to old age or otherwise, such as a procedure involving the removal of the uterus.
