His Eminence the Shaykh: I heard some of the young men in this break saying: We are unable to get married, and we want to go to some countries and get married with the intention of divorce. What is the ruling on their action?
What Allah willed, these people went to commit unlawful sexual intercourse. If they do that, they are committing unlawful sexual intercourse; because those who permitted marriage with the intention of divorce among the scholars intended the stranger who went for a purpose other than this, he went for trade, or for seeking knowledge, or for treatment and stayed there,Here the scholars differed: Is it permissible for him to marry with the intention of divorce or is it not permissible? Some of them permitted it, and some of them prohibited it. But as for going for this purpose, there is no doubt that this is unlawful sexual intercourse, and that no one among the people ever says this. If these people had feared Allah, He would have made for them a way out. If they had done what the Messenger (peace and blessings be upon him) guided them to, where he said: (O young men! Whoever among you can afford the marriage expenses, let him get married, for it is more effective in lowering the gaze and guarding the private parts. And whoever cannot afford it, let him fast) it would have been better.
These people went with a ticket and returned with a ticket, and stayed in hotels there which may be among the most expensive and highest-priced hotels, and they married for a certain amount, then they will return. So in reality, they went to commit unlawful sexual intercourse. They must repent to Allah (Mighty and Majestic) and fear Allah the Exalted, and follow the guidance of the Messenger (peace and blessings be upon him). Convey this to them from me. May Allah reward you with good.
