My mother married more than thirty years ago. She was between fifteen and seventeen years old at the time. She gave birth to a daughter, and when the baby was about fourteen days old, she was sleeping. When morning came, they found her dead, her color had changed, or turned blue, as if she had died from suffocation. She is doubtful and says: She is the cause—the mother— knowing that the child was born at eight months, and it is said: that a child born at eight months may not live long, and Allah knows best. We want the ruling. May Allah reward you with good?
The ruling is that the mother owes nothing; because she is not certain that she caused the child's death. If she is not certain, the original state is that her conscience is clear, even in the case of doubt. Even if it is more likely in her opinion that she is the one who killed her, she owes nothing. Certainty is required; because the original state is the clearing of the conscience. And since the child was also born in these eight months, and as you mentioned, the general rule is that she does not live, but this does not concern us. What concerns us is the original state of the mother's innocence, and that the child died by the divine decree and destiny of Allah.
