The ruling on one who bequeaths that he be prayed over in al-Masjid al-Haram and buried in Makkah or al-Baqi'
His Eminence the Shaykh: I decided and wrote in my will to my children that when I die, they should pray over me in al-Masjid al-Haram or al-Masjid al-Nabawi, and bury me in al-Baqi' or in Makkah. Is this permissible?
I do not think you should make such a bequest, and it is not obligatory for your children to fulfill this bequest; because if you bequeath this, you will subject them to severe hardship, burden them with money, and open doors for people that should remain closed; because people, out of their emotions, when they hear that so-and-so bequeathed that he be prayed over in al-Masjid al-Haram and buried in al-Baqi', they rush to do so, and this leads to matters whose consequences are not praiseworthy, which only Allah knows. So do not make this bequest. The earth of Allah is one, and everyone on earth will be resurrected on the Day of Resurrection from their place to the gathering, and no one will be left behind. And being buried in Makkah or al-Baqi' does not benefit you in any way. Yes, if you are close to Makkah, for example, if you are in al-Sharai' or in Jeddah, it might be said: that there is nothing wrong with this; because it is close and does not impose a burden, and it does not lead people to imitate this. But if you are far away, do not make this bequest, and your heirs are not obligated to fulfill this bequest.
