Question:
He says: There is a mosque in our country, and this mosque was built by one of the residents of the village. He bequeathed upon his death that he be buried in it, and now he is buried in the mosque. What is the ruling on that? And is it permissible for us to pray in this mosque? May Allah reward you with good.

Answer:
This is not permissible. This is ignorance on his part. It is obligatory to exhume him and move him to the graveyards. It is obligatory that he be exhumed and buried in the graveyards with the people, and that prayer be performed in the mosque.
As long as he is in the mosque, prayer is not performed in the mosque until he is exhumed, moved, and transferred to the public graveyard; because burial in mosques is not permissible. So if someone is buried in a mosque, he is exhumed and transferred. But if it was old and then the mosque was built over it, then it is the mosque that is removed, demolished, and taken away. But as long as he built the mosque and maintained it, and then was buried in it, he is transferred, exhumed, and moved to the public graveyard, and praise be to Allah.
