The ruling on one who assigns a specific amount to himself from his partner in a partnership
O honorable Shaykh! We love you for the sake of Allah.
The Shaykh: May Allah love you for the sake of Whom you love us, and we ask Allah to make us all among the beloved of Allah.
The questioner: May Allah reward you with good. Two men partnered in a shop with a ratio of seven shares to nine shares, and a dispute arose between them.So one of them said to the other: You take over the management of the shop in exchange for giving me three thousand per month, which is the owner of the seven shares, or give you four thousand five hundred net which you take and you are outside the shop. Is this permissible?The Shaykh: As for the first, it is not permissible for him to assign a specific amount for the month; because he may profit that amount or he may not profit it, so it is not permissible; because this is gambling.
As for if they agree to appraise the shop now,And they look at what its value is, then he says: I give you the value of your share of it, there is no harm.
