السؤال:
We return at the beginning of this episode to a message sent to the program from the Hashemite Kingdom of Jordan. The sender is a listener who says, “The sender is Awadh.” Our brother Awadh raised some of his questions in a previous episode, and in this episode he asks some of the questions. In one of them, he says: “I work in an orchard on a share-cropping basis, meaning I receive one-quarter of the harvest, and my partner has three-quarters. Is it permissible for me to give some of the orchard’s produce to someone without my partner’s knowledge, knowing that I give it merely for eating and not for sale?”
Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance. As for what follows:
If you know, if you know that your partner is pleased with this and allows it, then there is no harm—may Allah reward you with good. And if you do not know that, then seek his permission so that he grants you permission to give from the produce of this orchard to the brothers who visit you. This is in the category of fulfilling a trust, because the amount may be large, and there may be many visitors, which would harm your partner. But you ask him and say to him: “So-and-so and so-and-so come to me,” and you ask him for permission to offer what you see fit for the guest. This is if the amount is large.
As for the ordinary amount that is customary for people to offer to guests, and which does not harm your partner, the matter is broad in this regard—Allah willing. It is counted from the share of everyone, because the guest has a right upon everyone. And when a visitor comes, you offer him…… you offer him fruit, then there is no harm, if it is an ordinary amount that does not cause harm. But if the guests are many and this causes harm to your partner, then what I see, and what is more cautious for you, is to seek permission. As for the light, customary amount, there is no harm, and there is no need to seek permission.
The presenter : May Allah reward you with good, and may He do you good.
