O Shaykh! If a ma'mum joins behind an imam who is praying 'Isha or praying Maghrib, what should he do?
If he joins the imam who is praying 'Isha while he intends to pray Maghrib, and he joins him in the second rak'ah, he should say the taslim with him; because he has prayed three rak'ahs. If he joins him in the third rak'ah, he should complete one rak'ah after him. If he joins him in the first rak'ah, then when the imam stands for the fourth rak'ah in the 'Isha prayer, he should sit down intending to separate from the congregation, recite the tashahhud, and say the taslim. Then he should join the imam in the remainder of the 'Isha prayer. This is the stronger opinion.And some of the scholars said: He should pray Maghrib first, then join the imam in the remainder of the 'Isha prayer. However, the first opinion is better; so that a person does not separate from the congregation.

The questioner: What if he prays 'Isha first?Answer: If he prays it first, and he was ignorant, then he owes nothing. But if he was knowledgeable, it is not permissible; because if he does this, he has neglected the order. And here there is no need to neglect the order; because he is able to pray Maghrib and do as I mentioned to you.
