Ruling on constructing a building with a loan involving riba

Machine translationRead the Arabic original
The father is an ordinary layman. He had a piece of land and was building on it at night; he had a construction balance. When the time for registration came, he sold the house for no money, only on paper, to his wife’s daughter, who is his daughter by blood, in order to benefit from the government house, since it is not permissible to have a government house and registration—this is in the state of Kuwait. When the house was registered, he took the money and bought land, and with the rest of the money, he added a riba-based loan from the bank and built a building. It is now generating income, and this has been the case for ten years. What is the ruling, and what is the solution? May Allah reward you with good. The Shaykh: My opinion in this matter is that the man comes to me, and I consult with him, and then we look at the answer.

The questioner: O Shaykh, he is an ordinary layman.

The Shaykh: It is no use. Let the layman come, and we will look into the matter.

The questioner: It is as I told you, O Shaykh.

The Shaykh: There is no fatwa except for him.The questioner comes: He is not interested in the matter; I am the one interested, and I am his son.

The Shaykh: If he is not interested, then if there is sin, the sin is upon him. The questioner: And do I have the right to take the money he gives me?The Shaykh: If this money is from the value of the land he sold, do not take from it until a fatwa is issued.
