The Shaykh: And he has not yet prayed the sunset prayer?The questioner: And he has not yet prayed the sunset prayer.

The Shaykh: We say: He enters with them with the intention of the sunset prayer. The man entered the mosque and had not prayed the sunset prayer, and he found the people praying the night prayer.We say: Enter with them with the intention of the sunset prayer, and there is no blame on him; because the difference in intention between the imam and the one praying behind him does not harm.
If you enter in the second rak'ah, you say the closing salam with the imam; because you have prayed three rak'ahs. In the third rak'ah, when you say the closing salam, you perform one rak'ah. In the first rak'ah, when the imam stands for the fourth rak'ah, you sit, recite the tashahhud, and say the closing salam. Then, you join him in the remainder of the night prayer.
