Explaining what fiqh (Islamic jurisprudence) in the religion is, as intended by the Prophet (peace and blessings be upon him) in his saying: “Whomever Allah wishes good for, He grants him understanding of the religion”

The Shaykh : And if you understand this reality, it will lead you to recognize the error of many of today’s contemporary writers who have not been granted the correct fiqh (Islamic jurisprudence) that the Prophet (peace and blessings be upon him) intended in the well-known authentic hadith:
He upon whom Allah intends to bestow goodness, He confers upon him an insight in religion مَن يُرِدِ اللهُ به خيرًا يفقِّهْه في الدِّين
Sahih Muslim 1037a
. Fiqh (Islamic jurisprudence) in the religion is understanding the Book of Allah and the hadith of the Messenger of Allah (peace and blessings be upon him). It is not that a man studies a specific school of jurisprudence; because that school contains what agrees with the Book and the Sunnah and what does not. Every school of jurisprudence followed, including the four schools and others, contains what is obligatory to adopt, what is permissible to adopt, and what is not permissible. The ruling in this matter is the statement of Allah (Blessed and Exalted is He):
And if you disagree over anything, refer it to Allah and the Messenger, if you should believe in Allah and the Last Day. That is the best [way] and best in result.
[An-Nisa 4:59]
. This type of fiqh (Islamic jurisprudence) is very, very little, unfortunately, in the present age. It is rare for the writers and speakers to be those who have studied this correct fiqh (Islamic jurisprudence). Rather, their fiqh (Islamic jurisprudence) is similar to the science of kalam (theology); just as the science of kalam (theology) deviates from the Book and the Sunnah, so traditionalist fiqh (Islamic jurisprudence) deviates in many of its details from the Book and the Sunnah. My aim is to say that we hear today from many writers who graduated from some universities that have no connection to teaching their students the fiqh (Islamic jurisprudence) of the Book and the Sunnah, but rather teach them the fiqh (Islamic jurisprudence) of a specific school. Some of them go so far as to teach what is called today comparative fiqh (Islamic jurisprudence). In reality, comparative fiqh (Islamic jurisprudence) today is a waste of time, causing the student of knowledge to be lost among the multitude of opinions.

The questioner : Peace be upon you and Allah's mercy.

The Shaykh : And upon you be peace, and the mercy of Allah and His blessings.

The questioner: Peace be upon you.

The Shaykh : And peace be upon you. The student of knowledge is lost among those many opinions that contradict each other severely. He graduates with a doctorate, they claim, but he is confused about many of those branch issues he received from some of his teachers. The result of this confusion is that he takes from those contradictory opinions whatever suits his desire. I fear I will continue in such digressions too much and we will lose sight of the main purpose.
