The Shaykh : And if you understand this reality, it will lead you to recognize the error of many of today’s modern writers, who have not been granted the correct fiqh (Islamic jurisprudence) that the Prophet (peace and blessings be upon him and his family) intended in the authentic hadith known by the wording:
He upon whom Allah intends to bestow goodness, He confers upon him an insight in religion مَن يُرِدِ الله به خيرًا يفقِّهه في الدين

. Fiqh in the religion is understanding the Book of Allah and the hadith of the Messenger of Allah (peace and blessings be upon him and his family); it is not for a man to specialize in one of the madhahib (schools of jurisprudence), because that madhhab contains what agrees with the Book and the Sunnah and what does not. Every one of the followed madhahib, including the four and others besides them, contains what must be adopted, what is permissible to adopt, and what is not permissible. The criterion in this is His saying (Blessed and Exalted is He):
And if you disagree over anything, refer it to Allah and the Messenger, if you should believe in Allah and the Last Day. That is the best [way] and best in result. فَإِنْ تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ إِنْ كُنْتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الْآخِرِ ذَلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا
[An-Nisa 4:59]
. This type of fiqh is very, very rare, unfortunately, in the present age for the writers and speakers to be those who have acquired this correct fiqh. Rather, their fiqh is more like 'ilm al-kalam (theology), just as 'ilm al-kalam deviates from the Book and the Sunnah, so traditional fiqh deviates in many of its details from the Book and the Sunnah. My aim is to say: We hear today from many writers who graduated from some universities that have no history of teaching their students the fiqh of the Book and the Sunnah, but rather teach them the fiqh of one of the madhahib. Some of them go so far as to teach their students what is called today comparative fiqh. Comparative fiqh is, in reality, a waste of time today; the student of knowledge is lost among those many contradictory opinions, which contradict each other severely. He graduates having obtained a doctorate, they claim, but he is confused about many of those legal issues he received from some of his shaykhs. The result of this confusion is that he takes from those contradictory opinions whatever suits his desires.
