The Shaykh : I said at the beginning of this talk that the Messenger (peace and blessings be upon him) mentioned the buy-back sale (‘inah) in the first hadith as an example, not as a definitive limit. This is because the buy-back sale (‘inah) is only made permissible through some degree of deception and some alteration of names, as the Messenger (peace and blessings be upon him) indicated in the authentic hadith when he said:
There will certainly be among my Ummah people who drink intoxicants and call them by other names. ليكونن في أمتي أقوام يشربون الخمر يسمونها بغير اسمها
This is the buy-back sale (‘inah); they call it a sale, but this is not a lawful designation. For among sales, some are forbidden and some are permissible. The fact that this is called a sale does not imply that it is permissible, as long as the Messenger (peace and blessings be upon him) mentioned it as one of the causes by which, if Muslims were to follow it, they would be humbled.
